Warranties
Drugco Discount Pharmacy sells new medical equipment and refurbishes and resells pre-owned medical equipment. If the equipment that you purchased from DRUGCO is new, the manufacturer’s warranty shall govern any product warranty claims. If the equipment you purchased is sold as pre-owned and refurbished, then DRUGCO warrants that the product will perform free of defects and workmanship for a period of 90 days from the purchase date, or date of shipment, whichever comes first, except for certain “disposable” products and products with a stated warranty of less than 90 days, as specified on the buyer’s invoice.
DRUGCO shall not be liable for any incidental, special, or consequential loss, damage, or expense directly or indirectly arising from the use of any product purchased from DRUGCO or its assigns. Liability under this warranty and buyer’s exclusive remedy under this warranty is limited to servicing or replacing, at DRUGCO's option, any product that, under normal use and service, appears to DRUGCO to have been defective in material and workmanship. Under no circumstances is the buyer authorized to have any refurbished equipment sold by DRUGCO serviced by someone not authorized or employed by DRUGCO or its assigns, other than service such as normal preventive maintenance, replacement of “disposable” components, and electrical safety testing as required by Federal, State, and local ordinances. The use of any unauthorized services shall void the equipment warranty immediately. The buyer is responsible for electrical safety testing in their facility as required by ordinances.
No agent, employee, or representative of DRUGCO has any authority to bind DRUGCO to any affirmation, representation, or warranty concerning its products or workmanship, and any affirmation, representation, or warranty made by any agent, employee, or representative shall not be enforceable by the buyer.
This warranty is expressly in lieu of any other express or implied warranties, including any
implied warranty or merchantability or fitness, and of any other obligation on the part of DRUGCO.
DRUGCO shall not be liable for any defects, non-performance, or performance of equipment not within the manufacturer’s specifications or tolerances that results from the buyer’s failure to use and maintain the equipment in accordance with the manufacturer’s recommendations or guidelines, or due to normal wear.
Damage to any product or parts through misuse, neglect, accident, or by affixing any non-standard attachments or by any customer modification shall void this warranty. DRUGCO makes no warranty whatever in regard to trade accessories and “disposables”, such being the warranty of their respective manufacturers. This warranty applies to equipment only, and does not apply to “disposable” equipment components recommended by either the original equipment manufacturer or the “disposable” manufacturer as a component requiring replacement or maintenance more frequently than once per year, or on a per use or per multiple use basis. Buyer’s failure to replace “disposable” components as recommended or required by the equipment manufacturer or “disposable” manufacturer shall void this warranty. Buyer’s failure to use “disposable” components specified for use with the equipment, either by the component manufacturer or original equipment manufacturer shall also void this warranty.
